These Terms of Use apply to all users and others who register with, access or use our web application BoostPixels.

By accessing this website we assume you accept these terms and conditions. Do not continue to use BoostPixels if you do not agree to take all of the terms and conditions stated on this page.

These terms constitute a legally binding agreement between you and BoostPixels. If you are using the service on behalf of another person or entity, you represent that you are authorized to accept these terms on their behalf and that they will be responsible for any violations of these terms by you or the other person or entity.

To use BoostPixels, you must be at least 18 years old. If you are under the age of 18 (or the age of majority in your jurisdiction), you are not allowed to use BoostPixels. If you have any questions about these terms or BoostPixels, please feel free to contact us via email.

We strive to carefully monitor and adjust the settings of our AI model, but it is possible that some users may encounter content that they find inappropriate or offensive. If you come across any such content, please do not hesitate to contact us by email. We will take prompt action to address any inappropriate content that you bring to our attention.

BoostPixels is a software application that uses artificial intelligence to edit, modify, and transform photos. With BoostPixels, you can upload photos. Any processing of the photos that you submit through BoostPixels is governed by our Privacy Policy.

We reserve the right to make changes, improvements, or updates to BoostPixels at any time and without notice to you. We may also stop operating part or all of the application or disable certain features at any time.

We do not claim ownership over any content that you upload to BoostPixels or is generated using BoostPixels.

When uploading photos to BoostPixels, you are confirming that you own the rights to the photo or have obtained permission to use it. You also agree to be responsible for any royalties or fees that may be owed as a result of using the photo on BoostPixels. If the photo includes the likeness of any third parties, you must have obtained their consent to use their image and you confirm that you have the legal authority to enter into these terms.

Naked or pornographic photos are not allowed. BoostPixels is not responsible for any negative consequences that may result from uploading unlawful content.

When using BoostPixels, you agree not to violate any applicable laws or third-party rights, including intellectual property laws and the rights of the company.

You represent, warrant, and agree that you will not use BoostPixels in any way that is harmful, fraudulent, deceptive, harassing, threatening, intimidating, predatory, defamatory, obscene, stalking, or otherwise objectionable.

You may not use the service for any unauthorized or illegal purposes, or engage in activities that violate these terms.

You may not interfere with the functioning of BoostPixels or access any feature or area of the service that you are not authorized to access.

You may not display, mirror, or frame BoostPixels or any of its content without written consent.

You may not access or attempt to access any servers, computers, or databases connected to BoostPixels without authorization.

You may not copy, modify, host, stream, sublicense, or resell the service. You may not advertise any products or services in BoostPixels without prior written approval. You may not violate any applicable laws or regulations.

You may not encourage or assist others to do any of the foregoing.

Due to the fact that we use Stable Diffusion AI technology in BoostPixels for creation of the photos, you additionally represent, warrant and agree that you will not Use BoostPixels or Stable Diffusion AI technology in the following ways, which are explicitly prohibited under the Stable Diffusion AI technology license. 

You may not use it to defame, disparage, or harass others.

You may not use it for fully automated decision-making that negatively impacts an individual's legal rights or creates or modifies a binding, enforceable obligation.

You may not use it in a way that discriminates against or harms individuals or groups based on their online or offline social behavior or personal or personality characteristics.

You may not use it to exploit the vulnerabilities of a specific group of people based on their age, social, physical, or mental characteristics in a way that causes or is likely to cause physical or psychological harm to that person or another person.

You may not use it in a way that discriminates against individuals or groups based on legally protected characteristics or categories.

You may not use it to provide medical advice or results interpretation.

You may not use it to generate or disseminate information that is intended to be used in the administration of justice, law enforcement, immigration, or asylum processes, such as predicting whether an individual will commit fraud or a crime.

You can acquire content on our services for free or for a charge, either of which is referred to as a “Transaction.” Each Transaction is an electronic contract between you and BoostPixels.

BoostPixels will charge your selected payment method for any paid transactions, including any applicable taxes. Once a transaction is completed, it is considered final. However, the prices of content may change at any time. If technical issues prevent or unreasonably delay the delivery of content, your only options for resolution are to receive a replacement for the content or a refund for the price you paid, as determined by BoostPixels. In certain circumstances, BoostPixels may refuse to process a payment, cancel a payment, or deny a refund request if there is evidence of fraud, abuse, or other inappropriate behavior that gives BoostPixels the right to make a counterclaim.

If we cannot charge you, you remain responsible for any uncollected amounts, and we may attempt to charge you again or request that you provide another payment method. 

These Terms and your Use of BoostPixels will be governed by, construed and enforced in accordance with the laws of The Netherlands, without regard to conflict of law rules or principles that would cause the application of the laws of any other jurisdiction.
